Terms of Service

1. Introduction

Welcome to PieForge. These Terms of Service ("Terms") govern your use of the PieForge mobile application ("App") and related services provided by MiddenSoft (a GlassHill Ventures brand) ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the App. If you are under 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for your personal, non-commercial purposes

This license does not include the right to:

• Modify, reverse engineer, or create derivative works of the App
• Copy, distribute, or publicly display the App or its contents
• Use the App for any commercial purpose without our prior written consent
• Remove or alter any proprietary notices or labels on the App

4. User Accounts

Some features of the App may require you to create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

5. In-App Purchases and Subscriptions

The App may offer in-app purchases, including but not limited to:

• Pro Features: One-time purchase to unlock premium features including the full Recipe Book, unlimited oven profiles, and advanced timer features

Payment Processing

All payments are processed through the Google Play Store (or Apple App Store, when available). Payment terms, processing, and refunds are governed by the applicable app store's policies.

Pricing

Prices for in-app purchases are displayed in the App and may vary by region. We reserve the right to change prices at any time, but price changes will not affect purchases already made.

Open Testing Period

During the Open Testing period, Pro features may be available for free. When the App officially launches, Pro features will require a paid purchase. Users who access Pro features during Open Testing are not entitled to free access after the testing period ends.

Refunds

Refund requests must be submitted through the Google Play Store (or Apple App Store) according to their refund policies. We do not process refunds directly.

6. User Content

The App allows you to create and store content such as custom recipes, notes, and preferences ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive license to store, process, and display your User Content as necessary to provide the App's functionality.

You are solely responsible for your User Content and represent that:

• You have the right to create and share the content
• Your content does not infringe on any third-party rights
• Your content does not contain illegal, harmful, or objectionable material

7. Intellectual Property

The App, including its design, features, content (excluding User Content), trademarks, and all related intellectual property, is owned by MiddenSoft or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The recipes, timing instructions, and other content provided in the App are the property of MiddenSoft. Unauthorized copying, distribution, or commercial use of this content is prohibited.

8. Prohibited Conduct

When using the App, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated tools to access or collect data from the App
• Upload viruses, malware, or other harmful code
• Impersonate others or provide false information
• Use the App for any illegal or unauthorized purpose

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The App will meet your specific requirements
• The recipes or cooking instructions will produce desired results

Food Safety Disclaimer

The App provides cooking times and temperatures as general guidance. Actual cooking times may vary based on your equipment, ingredients, and other factors. You are responsible for ensuring food safety, including proper cooking temperatures and handling. We are not responsible for any illness, injury, or damage resulting from the use of recipes or cooking instructions in the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDDENSOFT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages resulting from your use or inability to use the App

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless MiddenSoft and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Termination

You may stop using the App at any time by uninstalling it from your devices. You may also request deletion of your account and data as described in our Data Deletion page.

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. Upon termination:

• Your license to use the App will immediately cease
• You must uninstall the App from all devices
• We may delete your account and User Content
• Provisions that should survive termination (such as disclaimers and limitations of liability) will remain in effect

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Updating the "Last Updated" date at the top of this page
• Providing notice through the App or by email (for material changes)

Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property rights.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MiddenSoft regarding the App.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
• Assignment: You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
